DMCA Policy & Copyright Notice

At RESoft (www.RESoft.ai), we respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we have adopted this policy to address claims of copyright infringement and to protect the rights of copyright owners.

If you believe that your copyrighted work has been copied and is accessible on the RESoft platform in a way that constitutes copyright infringement, you may submit a notification of claimed infringement to our Designated Agent.

2. Takedown Claim Guidelines (For Copyright Holders)

To file a valid DMCA takedown notice with RESoft, the written notification must include substantially the following information, as required by 17 U.S.C. § 512(c)(3). Incomplete notices may not be processed.

  1. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the Work: Identification of the copyrighted work(s) claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works may be provided.
  3. Identification of the Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled. This must include information reasonably sufficient to permit RESoft to locate the material (e.g., specific URL(s) where the material is located).
  4. Contact Information: Information reasonably sufficient to permit RESoft to contact the complaining party, such as an address, telephone number, and, if available, an email address.
  5. Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy/Permission Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification Process (For Users)

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent. To be effective, the counter-notification must be a written communication that includes substantially the following:

  1. Signature: Your physical or electronic signature.
  2. Identification of Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled (e.g., the original URL).
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Contact Information: Your name, address, and telephone number.
  5. Jurisdiction Consent: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which RESoft may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.

Upon receipt of a valid counter-notification, RESoft will forward a copy to the original complaining party. The original complaining party will then have ten (10) business days to notify us that they have filed an action seeking a court order to restrain the user from engaging in the infringing activity. If we do not receive such notice, we may restore the removed material.

4. Repeat Infringer Policy

In accordance with the DMCA and to maintain our Safe Harbor status, RESoft has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are determined to be repeat copyright infringers.

We also reserve the right to terminate the accounts of users who are the subject of a single, serious infringement complaint, or who otherwise violate our Terms of Service.

5. Expeditions Response

Upon receiving a valid and complete takedown notice, RESoft will act promptly and expeditiously to remove or disable access to the allegedly infringing material. We will also make a reasonable attempt to notify the user who posted the material.
